Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Pivot Transformation ("we," "our," or "us") regarding your use of our website, services, and offerings, including The Alignment Diagnostic, DISC assessments, coaching services, and related products.

By accessing our website or purchasing our services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

Services Description

Pivot Transformation provides diagnostic and coaching services for high-performing professionals, including:

The Alignment Diagnostic: A comprehensive diagnostic assessment combining DISC Behavioral Assessment with proprietary frameworks (The Six Levels of Alignment™, Decision Posture analysis, Alignment Tension identification)
Diagnostic Interpretation Sessions: 1-on-1 conversation-based sessions to interpret assessment results and identify behavioral patterns
Coaching Services: Ongoing coaching and advisory services for sustained transformation and realignment
Reports and Analysis: Comprehensive reports and diagnostic materials beyond standard personality assessments

Our services are diagnostic in nature, focused on pattern recognition and clarity rather than prescriptive solutions. We provide frameworks for understanding alignment, identity, and decision posture.

User Eligibility and Obligations

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that:

You are at least 18 years old
You have the legal capacity to enter into these Terms
All information you provide is accurate and complete
You will use our services only for lawful purposes
You will not misuse or attempt to gain unauthorized access to our systems

Purchase and Payment Terms

Pricing and Payment

All prices for our services are listed on our website and are subject to change without notice. Payment is required at the time of purchase unless otherwise arranged. We accept payment through secure third-party payment processors.

The Alignment Diagnostic Purchase Process

When you purchase The Alignment Diagnostic ($400), you will:

Receive immediate email confirmation of your purchase
Receive an assessment code to complete the DISC Behavioral Assessment
Receive a calendar link to schedule your 1-on-1 diagnostic interpretation session
Complete the assessment at your convenience prior to your scheduled session

Billing

By providing payment information, you authorize us to charge the payment method for all fees incurred. You are responsible for maintaining accurate and current billing information.

Refund and Cancellation Policy

The Alignment Diagnostic

Due to the immediate issuance of the DISC assessment code upon purchase, refunds for The Alignment Diagnostic are limited:

After Purchase: Once purchased, an assessment code is immediately issued and cannot be cancelled or revoked. No full refunds are available.
Before Interpretation Session: A 50% refund is available if requested before the diagnostic interpretation session has occurred, provided the request is made in writing.
After Interpretation Session: No refunds available once the diagnostic interpretation session has been completed.

Coaching Services

For multi-session coaching packages, refunds are prorated based on sessions completed. Cancellation requests must be submitted in writing.

Session Cancellations

Scheduled sessions may be rescheduled with at least 24 hours notice. Missed appointments without prior notice will be considered completed sessions and are non-refundable.

Intellectual Property

Our Content

All content on our website and in our services, including but not limited to text, graphics, logos, frameworks, methodologies, diagnostic tools, assessment materials, and proprietary concepts (including The Six Levels of Alignment™, BE→THINK→DO→HAVE sequence, Decision Posture analysis, The i Within, and Alignment Tension frameworks) are the intellectual property of Pivot Transformation and are protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to:

Access and use materials provided through our services for your personal use
Download and retain reports and assessments created for you
Reference frameworks and concepts learned through our services for personal application

Restrictions

You may not:

Reproduce, distribute, or create derivative works from our proprietary frameworks or materials
Use our content for commercial purposes without written permission
Remove copyright or proprietary notices from materials
Reverse engineer or attempt to extract methodologies for replication
Share assessment codes or materials with unauthorized individuals

Professional Relationship and Disclaimer

Nature of Services

Our services provide diagnostic insight, pattern recognition, and clarity regarding alignment, identity, and decision-making. Our work is educational and developmental in nature. We are not providing:

Medical advice, diagnosis, or treatment
Mental health counseling or therapy
Legal, financial, or tax advice
Guaranteed outcomes or results

Client Responsibility

You are responsible for:

Your own decisions and actions based on insights gained
Seeking appropriate professional advice (medical, legal, financial) when needed
Engaging honestly and authentically in the diagnostic process
Implementing insights in ways that align with your circumstances

No Guarantees

While we are committed to providing high-quality diagnostic services, we do not guarantee specific outcomes or results. Individual experiences and results will vary based on numerous factors including personal circumstances, commitment, and external conditions.

Confidentiality

We maintain confidentiality regarding information shared during diagnostic and coaching sessions, subject to the following exceptions:

Where disclosure is required by law
Where there is imminent risk of harm to self or others
Where you provide written consent to disclose information
For anonymized use in case studies or testimonials (with your explicit permission)

Assessment data may be shared with our authorized service providers (such as PeopleKeys for DISC assessments) as necessary to deliver services, in accordance with our Privacy Policy.

User Conduct

You agree not to:

Use our services for any unlawful purpose
Harass, abuse, or harm other users or our staff
Transmit viruses, malware, or other harmful code
Attempt to gain unauthorized access to our systems or networks
Interfere with or disrupt our services
Impersonate any person or entity
Collect information about other users without consent
Share your account credentials with others

Limitation of Liability

To the fullest extent permitted by law:

Pivot Transformation, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
Our total liability to you for any claims arising from these Terms or our services shall not exceed the amount you paid for the specific service giving rise to the claim
We are not liable for any loss or damage resulting from: (a) your reliance on information provided through our services; (b) decisions you make based on diagnostic insights; (c) unauthorized access to your account; (d) interruptions or errors in our services

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Pivot Transformation and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of our services
Your violation of these Terms
Your violation of any rights of another party
Your provision of inaccurate or misleading information

Termination

We reserve the right to terminate or suspend your access to our services at any time, without prior notice, for:

Violation of these Terms
Fraudulent or illegal activity
Behavior that is harmful or disruptive to other users or our business
Non-payment of fees

Upon termination, your right to use our services will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, limitation of liability, and dispute resolution.

Dispute Resolution

Informal Resolution

If you have a dispute with us, we encourage you to contact us first to attempt to resolve the issue informally.

Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Georgia, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Pivot Transformation individually. To the fullest extent permitted by law, no arbitration or proceeding shall be joined with any other, no dispute shall be arbitrated on a class-action basis, and you waive any right to participate in a class-action lawsuit.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in the State of Georgia for resolution of any disputes not subject to arbitration.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Continued use of our services after changes constitute acceptance of the modified Terms.

For material changes, we will provide notice through email or a prominent notice on our website at least 30 days before the changes take effect.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the extent necessary to make it valid and enforceable while preserving its intent.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pivot Transformation regarding our services and supersede all prior agreements and understandings.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision shall be effective only if in writing and signed by an authorized representative of Pivot Transformation.
